The Month in Brief

With Labor Day approaching and summer winding down, we offer this combined July/August issue of our Communications Law Bulletin. With next month's edition, we return to our usual, monthly publication schedule.

As this combined issue shows, the summer months have not been quiet for the electronic communications industries. Notably, the Federal Communications Commission ("FCC" or "Commission") adopted an order that clarifies, at long last, the regulatory status of competing, broadband Internet access platforms based upon telephone and cable facilities. Also, the consolidation of the telecommunications industry proceeded as two mega-mergers closed and two others moved nearer to completion; and names of a possible replacement for Commissioner Abernathy and a nomination to fill the vacant Republican seat on the FCC began to circulate in Washington.

FCC Reduces Regulation of DSL as Expected

Following the Supreme Court's ruling in the Brand X case, which supported the FCC's treatment of cable modem service as an information service, the FCC at its August open meeting extended its information service treatment to wireline broadband Internet access services commonly delivered via digital subscriber line ("DSL") technology.
