The Supreme Court Rules Against Landowners In Temporary Regulatory Takings Case.

INTRODUCTION

The United States Supreme Court has rendered another important regulatory takings decision. In Tahoe-Sierra Preservation Council, Inc. v. Tahoe Regional Planning Agency, No. 00-1167 (April 23, 2002), a decision likely to be hailed by government agencies and environmental groups and assailed by landowners and developers, the Court ruled (6:3) that a temporary prohibition of the use of land does not effect a taking for which compensation is due under the Takings Clause of the United States Constitution.
